Terms and Conditions of Service

for Omnia Design

I value each client relationship and approach every project with care, creativity, and respect. These Terms and Conditions are here to ensure that our collaboration runs smoothly and that expectations are clear from start to finish. They outline how projects are managed, how communication and payments work, and what each of us can expect from the process. My goal is always to create a fair, transparent, and enjoyable working experience, one rooted in mutual trust and professionalism. Terms and Conditions

Scope
These Terms and Conditions apply to all artwork, graphic design, website development, and print services provided by Jean Schweitzer / Omnia Design. By commissioning work, the client agrees to abide by these Terms. Unless released in writing, copyright for all design work—including copy, concepts, proofs, and illustrations—remains with Jean Schweitzer until all invoices are paid. If multiple design concepts are submitted, only one is considered the final product fulfilling the contract; all others remain the property of Jean Schweitzer unless agreed otherwise in writing.

Project Acceptance
At proposal, Jean Schweitzer provides a written estimate and these Terms. Both must be signed and returned before work begins.

Design Fees
Fees are outlined in the estimate. A 50% deposit is required unless agreed otherwise. Work will not start until the deposit is received. Alterations and Extra Services: Changes beyond the estimate or after draft approval incur charges at the standard hourly rate (minimum 30 minutes), agreed upon before work begins.

Project Work
Clients are kindly asked to request work only when funds are available to pay upon completion, unless a prior written arrangement has been made. Timely payment helps ensure projects continue smoothly and supports a sustainable, respectful working relationship. A down payment is due upon project acceptance. The remaining balance, including any additional services, is due upon project completion unless otherwise stated on the final invoice or agreed upon in advance. Standard payment terms are 50% to begin and 50% upon completion. All proofs, digital files, print materials, and website content (including pages and posts) may contain a watermark or remain unpublished and will not be fully released until full payment is received. Omnia Design reserves the right to adjust payment terms based on a client’s payment history, project type, or scheduling needs. In certain cases, full payment in advance may be required.

Project Duration and Completion
Timelines are estimates. Completion depends on client feedback, revision count, and unforeseen circumstances. Clients are expected to provide feedback on proofs within 72 hours of delivery to help maintain project timelines.

If additional review time is needed, clients may request an extension; however, work completed to date must be invoiced and paid before the project is placed on hold for extended review.

A project is considered complete upon final payment. Additional services (printing, production, publishing) are treated as separate projects and billed accordingly.

Rush Jobs
Rush service (2–4 business days) may be available for a 25% surcharge.

Communication
Email is the primary method of communication and will serve as the official project record. Phone calls must be scheduled in advance, and text messages should be kept to a minimum. Most projects include brief complimentary calls, which can be arranged by email. Extended consultations or project-focused working sessions are billed at the standard hourly rate. Timely responses are essential to keep the project on track. Feedback on proofs is expected within 72 hours of delivery unless otherwise agreed in writing. Failure to reply to a project-related email within 72 hours may result in the project being placed on hold. If edits or approvals are not provided within 14 days (without prior explanation), the project may be cancelled and payments forfeited.

Website Maintenance Plans
Maintenance rates vary depending on the scope and complexity of the website and the level of service provided. Website maintenance plans are due and payable monthly or annually, depending on the client’s preference. Annual prepayment options may include a discount, depending on the plan. Monthly maintenance clients are required to maintain auto payment with a credit card on file. Automatic payments will be processed on the agreed-upon due date each month through Omnia Design’s secure payment processor. Clients may update their payment method or cancel this authorization at any time.

Payment Methods
Accepted payment methods are listed on the final invoice.

Default
Accounts unpaid after 30 days incur a 1.5% monthly late fee (18% annually). Returned checks are subject to a $30 fee. Jean Schweitzer may withhold or remove unpaid work until payment is received. Clients are responsible for any collection or legal fees incurred.

Data Formats
Text must be supplied electronically; images must meet agreed formats and quality standards. Jean Schweitzer is not responsible for poor-quality, client-provided, or scanned images.

Copyrights and Trademarks
The client confirms ownership or permission for all materials supplied. Work by Jean Schweitzer becomes client property upon full payment. Written permission is required for additional uses; additional fees may apply. Jean Schweitzer may showcase final designs in her portfolio or marketing materials. Clients indemnify Jean Schweitzer against any copyright or trademark claims.

Licensing
Fully paid work becomes the property of the client. Clients are responsible for registering designs and seeking legal advice as needed. Liability for claims is limited to fees paid.

Website Design
Clients have 10 days to review completed website projects. Minor revisions (text, images, or layout adjustments) are included. Failure to respond within 10 days constitutes acceptance of the project as delivered.

Design Credits
Clients allow a small credit or link to appear in the website footer and permit use of their project in the Omnia Design portfolio unless otherwise agreed.

Rights of Refusal
Jean Schweitzer may refuse or remove materials deemed immoral, offensive, obscene, or illegal. Violating content may be removed without penalty.

Cancellation
Cancellations must be made in writing. Clients will be invoiced for all work completed beyond the unused portion of any deposit. The balance will be due within 30 days.

Disclaimer
No warranties are expressed or implied. Jean Schweitzer is not responsible for performance issues, loss, or damages resulting from third-party materials, software, or hosting. Liability is limited to fees paid. Subcontractor or vendor terms may also apply.

Acceptance of Estimate and Terms
Acceptance of an estimate may be provided by any of the following: (a) Email referencing the estimate number or attaching the estimate, (b) Returning a signed physical copy, (c) Submitting an approved electronic signature (e.g., PDF/VeriSign), or (d) Payment of the required deposit. Any of these actions constitute acceptance of these Terms and Conditions and create a binding contract. By checking the box below and submitting this form, you acknowledge that you have read and understood these Terms and Conditions and agree to abide by them. These guidelines ensure a fair, respectful, and efficient working relationship for every project.
